Contract for the Supply of Goods
The display of goods on the site amounts to an invitation to treat only and is not an offer to sell goods at any price indicated. No contract for the supply of goods will be deemed to exist between you and the site. unless, and until, an email is sent by the site to you confirming that your order has processed by our staff and is being invoiced in full. This confirmation e-mail amounts to an acceptance of your offer to buy goods from the site and this acceptance is effective regardless of whether or not you receive the e-mail. The (FMSL) site are free to withdraw from a prospective contract at any time prior to acceptance. This also applies in the case of any error or inaccuracy in respect of the goods, any description applied to the goods, the availability of the goods or the order itself. Price and availability information is subject to change without notice.

The site. disclaims all such representations and warranties, including for example warranties of merchantability and fitness for a particular purpose. Pricing
The site reserve the right to amend pricing at any time. If however an order has been accepted, we will notify you prior to shipment of any change. You have the right to cancel the item from the order at no cost to either party.
The ‘Save’ price or value where indicated is based on typical retail values of such items or similar items obtained from normal retail outlets.

Price Promise
Price promise, we are confident that we will not be beaten on price. If you see the same product advertised at a lower price in stock and not on special offer, we will endeavour to match the price. This offer does not apply to prices you have been quoted for seconds or bulk orders. A Proof of the offers will be required. We will consider all price beat requests, however, any price beat will be offered at our discretion. We reserve the right to refuse a price beat at any time.

Product Images.
Where possible the image shown represents the goods. However, certain pictures may represent a different manufacturer, a generic form, a range of goods or an advertising image. In these cases the image does not necessarily accurately represent the product.

Processing of orders
– Your order may be delayed if the item is not in stock with our suppliers.
– Some items may be unavailable.
– We regret we are not able to supply dates our suppliers may get an item in stock.
– Value Added Tax (VAT) is included in the cost of goods shipped to countries within the European Union. The current rate is 23%.
– Shipments to Non-EU countries are not charged VAT.
– Shipments outside the European Union (EU) may be subject to local import charges and taxes, which are the responsibility of the purchaser.

Reward Points

Points are awarded for purchases completed based on Euro spent by retail customers only and can be redeemed on subsequent orders based on minimum and maximum points totals. Points are awarded at the discretion of Flashpoint Medical Systems Limited and are subject to a 6 month expiry. Points cannot be redeemed in conjunction with any other offer.

Delivery

The order in this instance should be delivered within 30 days of you making the online purchase. If the item does not arrive within this 30-day period, then you can contact us and ask that it be delivered at another date that is convenient for you. The Site (FMSL) cannot not be held responsible if we are not informed the good have not been delivered within 30days.

Returns
The Site (FMSL) will supply the Customer with products on the understanding that the Customer will have determined whether the products are suitable for the particular use to which they are to be applied.
In the event of a product not meeting the Customer’s requirements, it must be returned to the Company in an unused and resaleable condition within 30 days of delivery.

Personalised or Special order products cannot be returned under any circumstance. Product details and proofs will be confirmed before the order is completed.
A returns note must be completed by the Customer and returned with the products.

PPE, Medical Products and Consumables cannot be return due to infection control risk during Covid 19 or like event.

Batteries and Pads ordered cannot be returned due to Expiry Date and Shelf Life. Defibrillator Pads and Batteries are technically special orders and ordered from the Distributor only as required.
Products must be returned at customer’s own expense.
The Site (FMSL) will either make good any shortage or non-delivery; replace or repair any goods that are damaged or defective upon delivery; or refund to you the amount paid by you for the goods in question. In such circumstance photographs may be required.
Any credits and refunds will be made only after the Site (FMSL) receive and inspect the goods returned.
Refunds will only be provided using the same payment card used to place the order.
The Site (FMSL) reserves the right to refuse the Customer credits and refunds in the event of goods being returned in a used and/or unsaleable condition.
We shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions.
Our liability to you shall not in any event include losses related to any business of yours, such as loss of profits or business interruption, neither will we be responsible to you for any other loss which is not a foreseeable consequence of us being in breach of these Terms and Conditions or our legal duties.

Damaged & Missing Products:
The Customer must make any claims for damaged or missing product within 3 working days, of expected delivery date or receipt of delivery. The Site (FMSL) reserves the right to refuse any claims made after 3 working days. This does not affect the Customer’s statutory rights.

Online Product Images and Descriptions:
Images on the site may differ slightly from the products supplied. In such an event, the product supplied by The Site (FMSL) will still be fit for the purpose of its intended use.

Limitation of Liability
Except as specifically stated on this site, neither the site, nor any of its directors, employees or other representatives will be liable for damages arising out of or in connection with the use of this site. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.

Illegal Acts
It is a crime to use a false name or a known invalid credit card to order. Anyone caught wilfully entering an erroneous or fictitious orders will be prosecuted to the fullest extent of the law. We track the electronic ‘fingerprints’ of every order placed on the site to enable us to provide all legitimate crime prevention information to authorities to trace individual users engaging in criminal activities on our website.

Governing Law
All purchases from the site are subject to Irish Law.

Modification of Terms
The Site (FMSL) reserves the right to modify these terms at any time without prior notice. Any modification of these terms will be deemed to be effective from the date and time of posting on the Flashpoint Systems Supplies site.

Reservation of Title

Title to the Goods shall remain vested in the site (FMSL) and shall not pass to the Buyer until the purchase price for the Goods has been paid in full and received by the Site (FMSL).
